RJB Web Design provides a website design, hosting and ongoing support service. Our standard service operates as follows: • Website design and initial build: £0 • Website Hosting & Support: £20 per month • 24/7 WhatsApp support • Website maintenance and updates included within the monthly subscription • No separate design fee for the initial website build • No fixed minimum contract period unless otherwise agreed in writing The £20 monthly payment provides access to the website hosting and ongoing support service described in these Terms. The website is provided as part of an ongoing subscription service rather than as a one-off website purchase.
The initial website design and build is provided at £0 provided that the Client maintains an active £20 per month Website Hosting & Support Subscription. The Client does not pay a separate upfront website design fee under the standard service. RJB Web Design will work with the Client to create a website based on the information, branding, images, content and requirements supplied by the Client. The scope of the initial website build will be agreed between RJB Web Design and the Client.
The Client agrees to pay £20 per month for the continued provision of website hosting, website availability and hosting infrastructure, website maintenance, website updates, website content changes, text changes, image changes, layout changes, reasonable design amendments, technical support and 24/7 WhatsApp support. The £20 monthly subscription is an ongoing service fee. There is no separate charge for ordinary website amendments requested through the support service, regardless of whether the requested change is small or substantial, provided that the request can reasonably be completed within the website platform and existing service.
The Client may contact RJB Web Design through WhatsApp to request changes to the website. Examples include changing text, adding or removing images, changing prices, updating opening hours, adding or removing services, updating contact information, changing colours or other design elements, adding sections, updating existing pages, and making general content or design amendments. RJB Web Design will endeavour to complete reasonable requests as soon as reasonably practicable. The £20 monthly subscription does not guarantee an immediate response or immediate completion of every request. Response and completion times may vary depending on complexity, workload, technical limitations and third-party systems.
The Client may contact RJB Web Design via WhatsApp at any time regarding their website. "24/7 support" means that the Client may submit support requests at any time. It does not guarantee that every request will be responded to or completed immediately. RJB Web Design will generally respond as soon as reasonably practicable. Urgent technical issues affecting website availability will be prioritised where reasonably possible.
The standard £20 monthly subscription does not automatically include costs charged by third parties, including domain name registration or renewal fees, premium third-party software, paid plugins, paid applications, stock photography or paid media, advertising costs, Google or other advertising services, third-party booking systems, payment processing fees, premium fonts, templates or software, or third-party subscriptions requested by the Client. Where a third-party service is required, the Client will be informed where reasonably possible before an additional cost is incurred. Unless otherwise agreed, third-party services remain the responsibility of the Client.
Domain names may be purchased by the Client directly or, where agreed, RJB Web Design may assist with purchase or management. Unless otherwise expressly agreed in writing, the Client remains responsible for domain renewal fees, providing accurate domain information, maintaining ownership of the domain and keeping payment details up to date with the domain provider. A domain name is separate from the website hosting subscription. Cancellation of the £20 monthly subscription does not automatically cancel a domain registration.
The Client agrees to provide RJB Web Design with accurate information and materials reasonably required to build and maintain the website. The Client is responsible for ensuring that any content they provide is lawful and that they have the necessary rights to use it, including photographs, logos, written content, videos, trademarks, customer reviews and other copyrighted material. The Client must not request that RJB Web Design publish content that is illegal, fraudulent, defamatory, discriminatory, misleading or otherwise unlawful. RJB Web Design reserves the right to refuse to publish content that it reasonably believes may breach applicable law or another person's rights.
Unless otherwise agreed, the Client remains responsible for the accuracy of information displayed on their website. The Client should notify RJB Web Design when information changes, including prices, opening hours, contact details, addresses and services. RJB Web Design is not responsible for losses arising from inaccurate information supplied or approved by the Client.
RJB Web Design will use reasonable efforts to keep the Client's website available. However, continuous uninterrupted availability cannot be guaranteed. Website availability may be affected by hosting provider outages, domain provider problems, internet outages, third-party software, cybersecurity incidents, maintenance, technical failures or circumstances outside our reasonable control. Where an outage occurs, RJB Web Design will take reasonable steps to restore the website as soon as practicable.
The Client agrees to pay £20 per month for the Website Hosting & Support Subscription. Payment will normally be collected automatically using the agreed payment method. The subscription will continue on a rolling monthly basis unless cancelled in accordance with these Terms. The Client is responsible for ensuring that their payment method remains valid.
If a payment fails, RJB Web Design may contact the Client to request payment. If the outstanding amount remains unpaid, RJB Web Design may suspend the website and/or support service. The website may be taken offline until the outstanding subscription amount has been paid. RJB Web Design reserves the right to terminate the service where payments remain overdue.
The Client may request cancellation of the £20 monthly subscription. Cancellation requests should be made in writing, including by WhatsApp or another communication method accepted by RJB Web Design. Once the subscription is cancelled, the Client's access to the website hosting and support service will end at the end of the applicable paid subscription period, unless otherwise agreed. After cancellation, RJB Web Design will no longer be responsible for hosting, maintaining or updating the website.
The website is provided as part of the ongoing £20 per month service. If the Client cancels the monthly subscription, RJB Web Design may take the website offline once the paid subscription period has ended. The website will no longer be publicly accessible through the RJB Web Design hosting service. The Client will no longer receive website hosting, website maintenance, website updates, website amendments, 24/7 WhatsApp support or technical support included within the subscription. If the Client wishes to continue using the website after cancellation, a separate arrangement may be required and may be subject to additional charges.
The Client receives the benefit of the website while the monthly subscription remains active. Unless otherwise agreed in writing, the website is provided as part of RJB Web Design's ongoing hosting and support service and is not sold to the Client as a standalone website for a £0 one-off purchase. Cancellation of the subscription does not automatically transfer the website, website files, templates, licences, software or hosting infrastructure to the Client. The website is non-transferable and cannot be transferred to another hosting provider, platform or developer.
The standard £20 monthly subscription covers website amendments and support within the normal scope of the service. If the Client requests work that falls outside the normal website service, RJB Web Design may quote an additional fee. Examples may include development of a completely separate website, custom software development, complex bespoke integrations, development of external applications, advanced automation systems, services unrelated to the Client's website, or work requiring significant third-party development. No additional charge will be made without the Client's agreement.
RJB Web Design will take reasonable steps to maintain the security of the website and hosting environment. However, no website or online service can be guaranteed to be completely secure. The Client agrees not to intentionally attempt to compromise the security of the website, hosting environment or associated systems.
Where backups are available through the relevant hosting or website platform, RJB Web Design may use such backups to assist with restoration. Backups are not guaranteed to be available for every website or every historical version of the website. The Client should maintain copies of any important information they consider essential.
Websites may rely on third-party services or integrations, including website platforms, domain providers, Google services, WhatsApp, payment providers, maps, booking systems, analytics services, email services and social media platforms. RJB Web Design is not responsible for outages, changes, restrictions or failures caused by third-party providers. Where a third-party provider changes its service, pricing, functionality or terms, RJB Web Design may need to modify the website or service accordingly.
The Client retains ownership of materials supplied by the Client, including their business name, logo, photographs and original written content, subject to any third-party rights. RJB Web Design retains ownership of its own website development methods, templates, reusable design elements, code, systems, processes, tools, branding assets and proprietary materials. Third-party software, templates, plugins and other licensed materials remain subject to their respective licence terms.
Unless the Client specifically requests otherwise in writing, RJB Web Design may display the completed website as an example of its work in its portfolio, website, social media or other marketing materials. The Client may request that their website is not used for promotional purposes.
RJB Web Design will provide its services with reasonable care and skill. To the extent permitted by law, RJB Web Design will not be responsible for indirect or consequential losses arising from the use or unavailability of the website. Nothing in these Terms excludes or limits liability where doing so would be unlawful. Nothing in these Terms affects any statutory rights that cannot legally be excluded or limited.
RJB Web Design will not be responsible for failure or delay in providing services where the failure or delay is caused by circumstances outside its reasonable control, including internet outages, hosting provider failures, cyberattacks, natural disasters, power failures, government action, third-party service failures, strikes, telecommunications failures or other circumstances beyond reasonable control.
RJB Web Design may update these Terms from time to time. Where a material change affects the Client's service, RJB Web Design will provide reasonable notice. The latest version of these Terms will apply to the ongoing service after the effective date of the updated Terms, subject to applicable law.
The standard monthly subscription price is £20 per month. RJB Web Design reserves the right to change the monthly subscription price in the future. Where the price is increased, reasonable advance notice will be provided and the Client will have the opportunity to cancel the subscription before the new price takes effect, subject to applicable law.
RJB Web Design may terminate or suspend the service where payments remain unpaid, the Client uses the service for unlawful purposes, the Client attempts to compromise the website or hosting environment, the Client seriously breaches these Terms, the Client provides content that creates a legal or security risk, or continuing to provide the service would reasonably expose RJB Web Design to legal or technical risk. Where reasonably possible, RJB Web Design will provide notice before terminating the service.
RJB Web Design will process personal information in accordance with applicable UK data protection legislation and its Privacy Policy. The Client is responsible for ensuring that their own website complies with applicable privacy and data protection requirements relevant to their business. Depending on the website's functionality, this may include appropriate privacy policies, cookie notices, cookie consent mechanisms, data protection notices, terms of service and customer consent mechanisms. RJB Web Design can assist with implementing website functionality but does not provide legal advice.
Where the Client is a consumer rather than a business, nothing in these Terms is intended to remove or restrict any rights provided to the Client under applicable UK consumer protection legislation. Where the Client is purchasing the service for business purposes, different legal rights and protections may apply.
These Terms and the relationship between RJB Web Design LTD and the Client shall be governed by the laws of England and Wales, unless applicable law requires otherwise. Any disputes shall be subject to the applicable courts of England and Wales, subject to any mandatory rights the Client may have under applicable law.
By subscribing to the £20 monthly Website Hosting & Support service, the Client confirms that they have read, understood and agreed to these Terms and Conditions.
